Limiting Unsolicited Bulk Email

IMC's members have expressed a strong interest in helping to come up withsolutions to the problem of unsolicitied bulk email (UBE), betterknown as "spam". The use and abuse of UBE is spreading rapidly, andmany Internet users are complaining loudly about the very negativeeffects it has on them.

IMC Report Details Solutions to Unsolicited Bulk Email

Furthering its effort to help groups who are working to reduce or eliminateunsolicited bulk email, IMC has producedthe second of its reports on the problem. The report, "Unsolicited Bulk Email: Mechanisms for Control",lists the many technical and legal solutions being discussed and shows howthey affect Internet mail users.Many people believe that spam is caused by the fact that there are many openSMTP relays on the Internet. IMC's report on open relays, "Allowing Relaying in SMTP: ASeries of Surveys", analyzes the percentage of SMTP servers that areopen relays.

IMC Report Defines Unsolicited Bulk Email And Its Problems

Many groups are discussing ways to help reduce or eliminate unsolicited bulkmail. However, few of these groups, including thestate and national legislatures that are considering laws relating tounsolicited bulk email, have set down good definitions for what theyare trying to curtail and what the problems are.To aid these groups, IMC has written a report titled "UnsolicitedBulk Email: Definitions and Problems". The report gives precisedefinitions that are readable by laypeople and yet are precise enough forlegislators. Further, the report gives concise overviews of the problemsthat UBE causes, and who is most affected by these problems. It does nottake sides on which of the many solutions that have been proposed would bebest; instead, it lets the groups debating the issues start with a commonbase so that they can clarify how their particular solutions help alleviateparticular problems caused by UBE.

U.S. and State Anti-UBE Legislation

Many people know about the bills being considered by the U.S.Congress to limit UBE (a good overview of the bills can be foundat the Center For Democracy and Technology's"Junk Email" pages).However, there are now bills in many state legislatures that would banor limit UBE. There is a very good site at the John MarshallLaw School that covers bothfederaland state anti-UBE bills and laws.David Sorkin runs another good site that covers spam laws around the world.IMC has found that there has been very little legal research done onthe effectiveness of proposed anti-UBE legislation in the US. Becauseof this, IMC commissioned three legal memos that should aidlegislators and others who are considering or drafting laws that aremeant to reduce or prevent UBE. The memos are:Actions to Enforce Federal Unsolicited Fax Lawdescribes case law relating to the US junk fax law. It shows that it couldbe very expensive for recipients of UBE to pursue the senders unless thelaws are worded to allow class action suits and repayment of lawyers fees.Using Class Actions to Enforce Unsolicited Fax Lawdescribes a class action case using the current US junk fax law.This memo shows why any legislation that is meant to empower recipients ofUBE to sue the senders should include explicit allowances for class actionsuits.Small Claims Court Enforcement of Federal Unsolicited Fax Lawdescribes two problems with assuming that small claims courts is thebest way for individuals to get remedies in UBE-related cases.

Anti-UBE Resources

We have found many excellent articles that describe the problemsand possible solutions for UBE:Those Bulk Email Blues,from the 30-Sep-96 issue of TidBITS, is an excellent overview of the problemsof UBE. Of the dozens of articles we've seen, this is one of the mostconcise and practical, even if it's a tad old.The Berkeley Technology Law Journal has a superb articleon the legal aspects of UBE. The article,Garbage In:Emerging Media and Regulation of Unsolicited Commercial Solicitations,is a lengthy description of current US law and court rulings on many topicsthat are related to UBE.CommerceNet and the Silicon Valley Software Industry Coalition have prepareda very in-depth report titled UnsolicitedCommercial E-mail: Legislative Solutions. The report, created in November1998, details the many aspects of the UBE debate that a legislator needsto consider before passing anti-UBE laws.For up-to-date news about spam, there is an excellent newslettercalled spamNEWS. It covers spamfrom a variety of perspectives, and is a must-read for IS and mailmanagers.Phil Agre has put together an excellent guide calledHow toComplain About Spam that lists many anti-UBE tools and resources. Inaddition, there is a good overview ofanti-UBE resources organized by Scott Hazen Mueller. Another excellent listof anti-UBE resources is maintained by the Electronic Software PublishingCorporation.RFC 2505, "Anti-Spam Recommendations for SMTP MTAs",describes how you can help thwart spammers from using your SMTP serveras a launching pad for sending spam.RFC 2635, "DON'T SPEW: A Set of Guidelines for MassUnsolicited Mailings and Postings (spam*)", describes why unsolicited bulkemail (UBE, better know as spam) are harmful both to the Internet and to thesender. This Informational RFC brings together a great deal of good adviceabout spam and how to help prevent it from being sent.RFC 3098,How to Advertise Responsibly Using E-Mail and Newsgroupsor - how NOT to $$$$$ MAKE ENEMIES FAST! $$$$$ is a companiondocument that describes good marketing practices.One technical solution being proposed is to help SMTP servers filtermail.
